Wedding Photography Terms and Conditions (boring I know, but necessary!)

BOOKING AND DEPOSIT: A booking fee of £200 is required at the time of booking, together with a completed and signed contract. Dates are reserved only when these are received..

In the absence of a signature where a form is submitted digitally, a record will kept of online  / electronic correspondence and this will function in place of the signature. It is the responsibility of the client to ensure the security of the email or other electronic account used for this. Any correspondence originating from it will be accepted by both parties as having come from, or been authorized by, the client.

The client must make sure that all details, including dates and spellings, are complete and correct on the booking form. This forms the ‘master copy’ and may be referred to later on, for example when producing albums. Any errors made or costs incurred as a result of incorrect information or errors on the booking form shall be the responsibility of the client.

BALANCE PAYMENT: The remaining balance payment is to be paid as follows:

90 days from date of ceremony – 50% of outstanding balance.

7 days from date of ceremony – full outstanding balance.

Payment for printed media such as albums, prints and other media is made after the wedding at the time of ordering.

CREATIVE LICENCE: Sam Furlong shall be granted creative and artistic licence in relation to the choice of locations and poses used. Sam’s judgement on photographic style and the number of photographs taken shall be deemed correct. Due to changes in the weather, availability and willingness of subjects and other factors beyond his reasonable control, Sam will do his best to honour requested photographs but does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

COPYRIGHT: The 1998 Copyright, Designs, and Patents Act assigns copyright to Sam Furlong Photography. However the client will have the right to make copies of the imagery as per this contract, photographically, electronically, or by any other means and to use the resultant images in any way so long as said usage does not negatively impact Sam’s business.

Sam Furlong Photography will retain the right to use photographs from the wedding for any future advertising or promotional material unless specifically asked not to do so by the client.

EXCLUSIVITY: Sam Furlong Photography shall be the sole professional (still) photographer at the venue(s) and event(s) specified. If a second photographer is required, Sam can arrange one to work under his direction. He does however positively encourage family, friends, and other guests to take photographs throughout the day.

ILLNESS / FORCE MAJEURE: If Sam is unable to attend a wedding, with the clients agreement he will attempt to supply a photographer he judges to be of equal calibre in the first instance. If a suitable replacement cannot be found or agreed upon then liability is limited to a refund of any monies already paid.

 In the unlikely event of total photographic / equipment failure, injury, sickness or any other event beyond Sam Furlong’s control, liability shall be limited to a full refund of all monies paid.  Sam Furlong Photography has full Public Liability Insurance.

CANCELLATION: If Sam Furlong Photography has to cancel this contract for any reason, liability shall be limited to a full refund of all monies paid.

If you the client, cancel the contract, as compensation for loss of income to Sam Furlong Photography, the following charges apply as a percentage of the total remaining fee due: (Number of days before the wedding) 90 days or less - 100%, 91-180 days – 50%.  It is your responsibility to ensure that any instruction to cancel is received and confirmed by Sam Furlong Photography.

Obviously a wedding being cancelled or postponed can be a very stressful time for a couple. Sam advises the purchase of wedding insurance which includes cancellation cover. This  ensures all suppliers get paid and the stress on a couple is minimized at an already difficult time. Good levels of cover are available online for very little money.

Should the wedding be postponed then, subject to availability, all monies paid may be transferred to the new wedding date. Sam Furlong Photography reserves the right to alter the balance due if the new date and/or other arrangements make it appropriate and reasonable in his opinion. If it is not possible to accommodate the new date or the fee for the new date cannot be agreed then the contract will be deemed to have been cancelled by the client and fees as set out above will apply.

 In the event of Sam Furlong Photography taking another booking for the cancelled date a full refund of deposits and other monies paid shall be made.

DATA BACKUPS: Photographs and other associated data are held by Sam Furlong Photography on a computer editing and archiving system with multiple redundant backups to ensure safe keeping.

Should the digital media upon which the clients photos / data arrive be ‘dead on arrival’, the client must inform Sam within 48 hours of receipt and a replacement will be sent free of charge.  Sam may require the return the defective device for diagnostics. Sam Furlong Photography accepts no responsibility for the safe keeping of any photos or data after this time, the client becomes wholly responsible and should create backups immediately.

COMPLAINTS PROCEDURE: Please address any complaints to Sam Furlong Photography either by E-mail or telephone 01531 822816 / 07880 220141 09.00hrs – 18.00hrs Mon – Fri. Sam would endeavour to respond to any complaint within 24 hours.

PRIVACY: Sam Furlong Photography will store clients names and other details relevant to the booking on a private internal computer system and on a ‘cloud’ based system secured by 2 step authentication. These details will not be made available to companies or individuals outside of Sam Furlong Photography without clients express permission. A one off permission to supply information to a specific company or individual will not constitute a perpetual easement.

Once the booking is completed and the file closed, should a client wish their details to be deleted they should submit a request in writing or via email. Once received and acknowledged, all personal details will be removed from all systems and backups and all physical copies of data will be destroyed within 31 days.
